Despite its intended objectives, the Act has generated significant controversy, particularly concerning the compulsory acquisition of land and the adequacy of compensation provided to affected individuals. This study investigates the challenges associated with compulsory acquisition and compensation under the Land Use Act, using the Apa–Agatu Road construction project in Benue State as a case study. The research adopts a qualitative approach, drawing data from field surveys, interviews with affected landowners, government officials, and relevant stakeholders. Findings reveal that many affected individuals were either inadequately compensated or entirely excluded from the compensation process, largely due to a lack of proper documentation, poor public awareness, bureaucratic delays, and inconsistencies in valuation methods. The study also highlights the absence of transparency and participation in the acquisition process. It concludes that for the Land Use Act to serve justice, reforms are needed to ensure fair compensation, effective public engagement, and transparent valuation practices.
